The K-Beauty Investigator™ App processes ALL AI analysis 100% on your device. This means:

No personal data is transmitted to Awayion LLC servers for AI processing
No facial recognition data is collected, stored, or transmitted
No AR try-on data leaves your device
No AI Beauty Advisor conversations are recorded or transmitted
All ingredient analysis, color analysis, and beauty recommendations run locally on your phone

Awayion LLC does not act as a data controller or data processor (as defined under GDPR Article 4) with respect to any personal data analyzed by the App’s on-device AI features. This privacy-by-design architecture aligns with the NIST AI Risk Management Framework (NIST AI 100-1) “Privacy Enhanced” trustworthiness principle.

Data Retention

Data Deletion: To delete all App data, simply delete the app from your device. If you have an account, you can request account deletion through the App settings or by contacting us at info@awayion.com. AI Beauty Advisor conversations are automatically deleted when you uninstall the App as they exist only on your device.

Children’s Privacy

Awayion.com and the K-Beauty Investigator™ App are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. Users must be at least 18 years old (or have parental consent) to make purchases. If you are a parent and believe your child has provided us with personal information, please contact us immediately and we will delete it.

California Privacy Rights (CCPA/CPRA)

California residents have additional rights under the California Consumer Privacy Act, including:

Right to know if personal information is sold or disclosed
Right to opt-out of the sale of personal information

We do not sell personal information. The App’s on-device AI processing architecture means Awayion LLC does not “collect” personal data (as defined under Cal. Civ. Code § 1798.140(e)) from on-device AI features, as data never leaves your device.

California residents may request information about our data practices by contacting us. We will respond within 45 days.

GDPR Compliance (EU/EEA/UK Users)

If you are accessing Awayion.com or the K-Beauty Investigator™ App from the European Union, European Economic Area, or United Kingdom, you have additional rights under the General Data Protection Regulation (GDPR), including:

Lawful basis for processing: Consent (newsletter subscriptions, optional account creation) and legitimate interest (website analytics, fraud prevention).

On-device AI processing: Awayion LLC does not act as a data controller or data processor (as defined under GDPR Article 4) with respect to any personal data analyzed by the App’s on-device AI features, because no such data is transmitted to or accessible by Awayion LLC. AI analysis data is never transferred internationally.

International Data Transfers

If you are accessing Awayion.com from outside the United States, your information may be transferred to, stored, and processed in the United States where our servers are located. By using the website, you consent to such transfers. We ensure appropriate safeguards are in place for international transfers.

AI processing data is NEVER transferred internationally. All on-device AI features (ingredient analysis, AR try-on, color analysis, AI Beauty Advisor) process data exclusively on your personal device regardless of your location.

⚠️ Brand Integrity, Personal Identity Protection, and Anti-Spoofing Notice

The visual identity of Awayion.com — including but not limited to the Awayion® multicolor gradient design palette (purple #6b46c1 to coral #fd9e9e), the “Beauty Intelligence™” methodology name, the K-Beauty Investigator™ name and interface, the Moral Mirror: Aeternum™ name and assets, and all associated logos, typography, color schemes, page layouts, and design elements — constitutes the proprietary trade dress and intellectual property of Awayion LLC.

The following activities are strictly prohibited and constitute violations of federal and state law:

Website Spoofing: Creating any website, landing page, or online presence that imitates, replicates, or is confusingly similar to the visual design, color scheme, layout, or branding of Awayion.com
Brand Impersonation: Using “Awayion,” “Beauty Intelligence,” “K-Beauty Investigator,” “Moral Mirror,” or any confusingly similar designation in connection with any unauthorized product, service, social media account, or promotional material
Personal Impersonation of Aubrey Awayion: Creating any account, profile, website, social media presence, chatbot, AI persona, deepfake video, synthetic voice, or any other digital or physical representation that impersonates, imitates, or falsely purports to be Aubrey Awayion (founder and CEO of Awayion LLC) — including but not limited to: using her name, likeness, image, voice, writing style, or professional credentials to create false endorsements, fake testimonials, fraudulent communications, AI-generated content attributed to her, or any representation suggesting affiliation, sponsorship, or approval by Aubrey Awayion that has not been expressly authorized in writing
Trade Dress Copying: Reproducing or imitating the Awayion gradient color palette, design system, or visual identity in any commercial context
AI-Generated Brand or Personal Fraud: Creating any AI-generated, digitally altered, or synthetically produced content that depicts, represents, or purports to show Awayion products, services, brand identity, or Aubrey Awayion personally in a false or misleading manner — including deepfake videos, synthetic voice clones, AI-generated images, or chatbots impersonating Aubrey Awayion
Domain Squatting: Registering any domain name incorporating “Awayion,” “Aubrey Awayion,” “K-Beauty Investigator,” “Beauty Intelligence,” or confusingly similar terms

Legal Consequences: Violations constitute trademark infringement and unfair competition under the Lanham Act (15 U.S.C. § 1125(a)), false endorsement under Waits v. Frito-Lay, Inc., 978 F.2d 1093 (9th Cir. 1992), identity theft under N.C.G.S. § 14-113.20 (Class G felony, up to 47 months imprisonment), right of publicity violation under North Carolina common law (Flake v. Greensboro News Co., 212 N.C. 780 (1938)), unfair and deceptive trade practices under N.C.G.S. § 75-1.1 (treble damages plus attorneys’ fees), criminal counterfeiting under 18 U.S.C. § 2320 (up to $2 million fine and 10 years imprisonment), N.C.G.S. § 80-11.1 (Class H felony), and where applicable, violations of the TAKE IT DOWN Act (47 U.S.C. § 223, up to 2 years imprisonment). Awayion LLC and Aubrey Awayion personally actively monitor for brand and personal impersonation and will pursue all available civil and criminal remedies.

To report suspected spoofing, brand impersonation, or personal impersonation: Email info@awayion.com with subject line “Brand Impersonation Report” and include screenshots or URLs of the infringing material.

Proprietary Technology Protection

The K-Beauty Investigator™ App contains proprietary technology, AI algorithms, model weights, and trade secrets of Awayion LLC. These are protected under:

Digital Millennium Copyright Act (DMCA): 17 U.S.C. § 1201 — circumvention of AES-256 encryption or other access controls is subject to statutory damages and criminal penalties up to $500,000 and 5 years imprisonment
North Carolina Trade Secrets Protection Act: N.C.G.S. § 66-152 et seq. — misappropriation of trade secrets subjects violators to injunctive relief, damages, and attorneys’ fees
Defend Trade Secrets Act: 18 U.S.C. § 1836 et seq. — federal trade secret protection with ex parte seizure provisions
Computer Fraud and Abuse Act: 18 U.S.C. § 1030 — unauthorized access to protected computer systems

Reverse engineering, decompilation, disassembly, or any attempt to derive the source code, algorithms, or AI model weights of the App is strictly prohibited. See the Terms of Service for complete details.

Federal AI Policy Alignment

Awayion LLC develops the K-Beauty Investigator™ App consistent with the artificial intelligence policy of the United States as articulated in Executive Order 14179 (90 Fed. Reg. 8741), Executive Order 14365 (Dec. 11, 2025), and the NIST AI Risk Management Framework (NIST AI 100-1). The App’s 100% on-device processing architecture aligns with the NIST AI RMF “Privacy Enhanced” trustworthiness principle and the federal policy of promoting AI innovation free from unnecessary regulatory burden.

Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Privacy Policy shall be brought exclusively in the state or federal courts located in North Carolina. North Carolina General Statutes Chapter 75 (Unfair and Deceptive Trade Practices) constitutes the exclusive consumer protection framework governing this Privacy Policy.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by:
