9. 📲 On-Device Processing Disclosure

🔒 100% ON-DEVICE AI PROCESSING

All AI processing occurs exclusively on your personal device. No personal data, biometric data, facial analysis data, or AI model inputs or outputs are transmitted to Awayion LLC servers or any third-party servers. Awayion LLC does not operate as a data controller or data processor with respect to any personal data analyzed by the App’s on-device AI features. You are solely responsible for data stored on your personal device.

This privacy-by-design architecture ensures that your beauty analysis data never leaves your phone. The App’s AI models run entirely on your device’s processor, providing real-time results without any internet connection required for core AI features.

10. 💰 Digital Content Consumption and Refund Policy

NO REFUNDS — ALL SALES ARE FINAL

You acknowledge that the K-Beauty Investigator™ App delivers digital content and AI-powered analysis services that are fully consumed upon use through on-device processing. Once accessed, such digital content cannot be returned, reversed, or undelivered. All purchases are final upon delivery and consumption of the digital content. This includes but is not limited to:

Subscription fees (Members, Inner Circle)
One-time purchases (Founding Inner Circle, Moral Mirror: Aeternum™)
Virtual coin packages
Extra scan packages

By making a purchase, you explicitly acknowledge and agree to this no-refund policy. The AI Beauty Advisor cannot process refund requests.

⚠️ WAIVER OF COOLING-OFF PERIOD (EU/EEA/UK USERS)

Pursuant to EU Directive 2011/83/EU Article 16(m), UK Consumer Contracts Regulations 2013 Regulation 37, and California Civil Code § 1723:

By completing a purchase, you expressly consent to the immediate performance and delivery of digital content (including subscription access, Moral Mirror: Aeternum™ episodes, Beauty Coins, and scan packages) and you acknowledge that you thereby lose your right of withdrawal (14-day cooling-off period). Digital content delivered through this App is performed immediately upon purchase through on-device AI processing and cannot be reversed, undelivered, or returned once accessed.

You confirm: (1) your express prior consent to begin performance before the withdrawal period expires; (2) your acknowledgment that you will lose your right of withdrawal once performance begins; and (3) that you understand no refund will be issued after digital content delivery commences.

US Consumer Disclosure (FTC Act § 5):

All sales of digital content through this App are final. No refunds, exchanges, returns, or cancellations will be issued after purchase. This disclosure is provided before any transaction is completed in accordance with FTC guidelines on clear and conspicuous disclosure of material terms.

Platform-Specific Refund Handling:

For purchases through Apple App Store, refund requests are processed exclusively by Apple in accordance with Apple’s policies.
For purchases through Google Play, refund requests after the initial window should be directed to Awayion LLC at info@awayion.com.

⚠️ PROHIBITION ON FRAUDULENT CHARGEBACKS

Initiating a chargeback, payment dispute, or refund request containing any false, misleading, or materially inaccurate representation — including falsely claiming a transaction was unauthorized, that you did not receive the digital content, or that the App did not function as described — constitutes: (i) a material breach of this Agreement; (ii) potential wire fraud under 18 U.S.C. § 1343; (iii) potential violation of N.C. Gen. Stat. § 14-100 (Obtaining Property by False Pretenses, a felony); and (iv) an unfair and deceptive trade practice under N.C. Gen. Stat. § 75-1.1, subjecting you to treble damages under N.C. Gen. Stat. § 75-16. Awayion LLC reserves all rights to pursue civil recovery, attorneys’ fees, and referral to law enforcement.

11. 🔐 Reverse Engineering Prohibition

You shall not, and shall not permit any third party to:

(a) Reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, object code, algorithms, data structures, AI model weights, neural network parameters, or any other aspect of the App;
(b) Circumvent, disable, bypass, or impair any technological protection measure, encryption (including AES-256 encryption), or access control mechanism protecting the App;
(c) Use any automated tool, packet sniffer, memory debugger, hex editor, decompiler, or disassembler to access, extract, or analyze any portion of the App’s code, AI models, or proprietary technology;
(d) Attempt to reconstruct, discover, or replicate the App’s AI algorithms, model architecture, or processing logic through any means, including black-box behavioral analysis.

⚠️ TRADE SECRET AND DMCA ACKNOWLEDGMENT

The App contains trade secrets of Awayion LLC protected under the North Carolina Trade Secrets Protection Act (N.C.G.S. § 66-152 et seq.) and the Defend Trade Secrets Act (18 U.S.C. § 1836 et seq.). The AES-256 encryption and other technological measures constitute “technological measures that effectively control access to a work” under 17 U.S.C. § 1201(a). Circumvention subjects you to statutory damages, criminal penalties up to $500,000 and 5 years imprisonment under the DMCA, and additional liability under the Computer Fraud and Abuse Act (18 U.S.C. § 1030). Any breach of this Section shall cause irreparable harm; Awayion LLC shall be entitled to injunctive relief without posting bond, in addition to all other remedies.

12. 🛡️ Brand Integrity, Personal Identity Protection, and Prohibited Uses

You shall not:

(a) Create, distribute, or publish any AI-generated, digitally altered, or synthetically produced content that depicts, represents, or purports to show the App, its interface, functionality, results, or Aubrey Awayion personally in a false or misleading manner — including deepfake videos, synthetic voice clones, AI-generated images, or chatbots impersonating Aubrey Awayion;
(b) Use “K-Beauty Investigator,” “Awayion,” “Aubrey Awayion,” “Beauty Intelligence,” “Moral Mirror,” or any confusingly similar designation in connection with any unauthorized product, service, social media account, or promotional material;
(c) Create any account, profile, website, social media presence, chatbot, AI persona, or any other digital or physical representation that impersonates, imitates, or falsely purports to be Aubrey Awayion (founder and CEO of Awayion LLC) — including using her name, likeness, image, voice, writing style, or professional credentials to create false endorsements, fake testimonials, fraudulent communications, or any representation suggesting affiliation, sponsorship, or approval by Aubrey Awayion not expressly authorized in writing;
(d) Resell, sublicense, redistribute, or make available the App or any of its content to any third party;
(e) Create any clone, knockoff, or counterfeit version of the App;
(f) Register any domain name, social media handle, or app store listing incorporating the Company’s marks or the name “Aubrey Awayion.”

Violations constitute trademark infringement under the Lanham Act (15 U.S.C. § 1125(a)), false endorsement under Waits v. Frito-Lay, Inc., 978 F.2d 1093 (9th Cir. 1992), identity theft under N.C.G.S. § 14-113.20 (Class G felony, up to 47 months imprisonment), right of publicity violation under North Carolina common law, unfair and deceptive trade practices under N.C.G.S. § 75-1.1 (treble damages), criminal counterfeiting under 18 U.S.C. § 2320 and N.C.G.S. § 80-11.1, and where applicable, violations of the TAKE IT DOWN Act (47 U.S.C. § 223). Awayion LLC and Aubrey Awayion personally actively monitor for brand and personal impersonation and will pursue all available civil and criminal remedies.

13. 📋 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY NORTH CAROLINA LAW, AWAYION LLC’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO AWAYION LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00). IN NO EVENT SHALL AWAYION LLC, ITS MEMBER, MANAGERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING THE AI BEAUTY ADVISOR.

14. 🛡️ Indemnification

You agree to indemnify, defend, and hold harmless Awayion LLC, its member, managers, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your violation of these Terms; (b) your use of the App, including any misuse of the AI Beauty Advisor; (c) any fraudulent chargeback or payment dispute initiated by you; or (d) your violation of any applicable law or regulation.

15. 🚪 Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users. Termination does not entitle you to any refunds. You may also terminate your account at any time by deleting the App.

16. ⚖️ Governing Law and Jurisdiction

This Agreement and any dispute arising out of or relating to this Agreement, the App, or your use of the App shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Forsyth County, North Carolina. You irrevocably consent to the personal jurisdiction of such courts, waive any objection to venue, including any claim of inconvenient forum, and agree that service of process may be made by any means permitted by North Carolina law.

The Company is organized under the laws of North Carolina, maintains its principal place of business in North Carolina, and developed the App in North Carolina. All AI processing performed by the App occurs on your personal device; no personal data is transmitted to Company servers in any jurisdiction. North Carolina General Statutes Chapter 75 (Unfair and Deceptive Trade Practices) constitutes the exclusive consumer protection framework governing this Agreement.

17. 🇺🇸 Federal AI Policy Alignment

Awayion LLC develops the K-Beauty Investigator™ App consistent with the artificial intelligence policy of the United States as articulated in Executive Order 14179 (90 Fed. Reg. 8741), Executive Order 14365 (Dec. 11, 2025), and the NIST AI Risk Management Framework (NIST AI 100-1). The App’s 100% on-device processing architecture aligns with the NIST AI RMF “Privacy Enhanced” trustworthiness principle, FTC data minimization guidance, and the federal policy of promoting AI innovation free from unnecessary regulatory burden. This privacy-by-design architecture ensures no personal data is transmitted to external servers, consistent with NIST Privacy Framework 1.1 recommendations for managing AI-related privacy risks.

18. 📝 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via the App. Continued use of the App after changes constitutes acceptance of new Terms.
